Brief Description: FHWA conducted an informal review of a bus shelter program which has been in effect in New York City for the last three years, and it is their opinion that the presence of shelters of this design, with their limited use for advertising, is not inconsistent with the purposes of 23 CFR 1.23 in urbanized areas. At this time, FHWA requires specifically that State or local jurisdictions award bus shelter franchises on the basis of public invitations, and that equal access should be provided to all qualified advertisiers at reasonable rates.
